Legal Question in Family Law in India

maintenance by husband

husband is employed in MNC. which he admit in court. Now i have heard from somewhere he has left the job and not working anywhere...doing his own work at home . how will the court assess the maintenance in that case? I am sure he is still employed , if not in the same company then in another one. how to go about it.

The court may make his last drawn salary as the basis of his income.

you may apply to the court to ask him to produce his (latest) salary slip or his income statement.

you can call for the employment record of your husband including the last salary drawn and the court would pass the order on the basis of his previous employment as he is capable of earning that much salary.

You may approach to the family court and issue a search summons to the company where he is working.
