Is it true that if the decree of restitution of conjugal rights goes in his favour, he will escape from paying me and my daughter maintenence and child support?

I plan to get a divorce from my 8 year old husband.I am fighting a domestic violece case against him.I have no wish to return to him.He has filed a petition for restitution of conjugal rights.My only concern is that will he escape maintennece just because a decree in his favour comes.

the maintenance and child support cannot be avoided. you are also entitled to pursue your remedies under the DVA.

No,he can not escape from paying you maintenance even if you choose not to join him.
