Legal Question in Family Law in India

we married in arya samaj mandir without the consert of her and my family. since marriage she is living with her mother. After six month she told her mother that she married me. there family told me that they send her girl after doing marrige publically. Now they file a false case of dowry against me and want 10 lakh for mutual divorce. She is the only earning member of the family. Her mother dont want to send her now nor she want to come. can she is a govt employee and i m working in pvt org.

She earned more than me.

Can she claim the maint

And can my family come under the dowry case

Pl give suggestions

dear bro first of all you made the mistake that after marriage you send ur wife at her parents house without any stay with you.

Now if she is earning hand then she cannot claim any maintenance.

But u can still handle your case but you have to send ur details.

Yes she can claim maintenance from you and your family can come under dowry case too.

If she is earning more than you, a claim for maintenance may not be entertained. However, to avoid dowry case you need to approach the mediators / family members from both sides and try to reach an amicable settlement.
