I got married in Dec 2009 and soon after 1 month in Jan i got separated as i was not comfortable with him but there are many gifts and gold jewelery with him and he is refusing now to give me that. I want to apply for divorce as soon as possible.I want to know what is more advisable me applying for the divorce & streedhan first or waiting for him to file divorce first. Kindy advise & help me, would highly obliged & Thanks

its totally upon you. if you are willing to live with him then wait otherwise file the divorce immediately as the procedure will take time. if both of you are ready for divorce then file mutual consent divorce as it will be decided soon. if the ornaments are not too pricey then leave them or you can take them as settlement amount ... all this can be decided when you will take decision over filing of divorce.
you have to file complaint in police and police will register case of 498a and 406 case and you will get your dowry and jewellery etc.
