Legal Question in Family Law in India

I got married in may 2010 in India, My marriage is not consummated due to differences in opinions; we lived together only for 2 months. After marriage every day we had fights and never ending arguments, This in-tolerable and I started avoiding her.

I still do not know what she expectes from me and why she is not happy with me. Now it will be 2 years in December, Since we both had last communication.

Her parents are troubling my parents in India and spreading rumors about me in office and amoung my friends. They are demanding 10 lack rupees and out of court settlement. She is not in favor of joining my parent in India or stay with me. I have project lasting for 1 year in USA. There was no exchange of dowry or gifts in my marriage. Whole expense of my marriage does not exceed 5 lacks.

Now since its more than 2 years, I m also not in favour of sustaining the relations ship. What are my options with divorce and risks associated with out of court settlement?

it is advisable to settle the matter amicably and for that you may seek help of a lawyer who would mediate between you and her. in case the mediation fails, you may go for divorce on the grounds available to you.

There is no risk in out of court settlement. You may settle the whole issue and get mutual consent divorce.

First try to settle the matter amicably, else you can file case of divorce, in India court.
