Legal Question in Family Law in India

I got married 3 months earlier,it was a love marriage,my husband is really short temepred and behave very badly and becomes verbally abusive on petty things,i knew him from lasst five years and it was his nature since begining,though i thought he would improve after marriage but he's same as he was earlier.if i become upset for something then he behaves very badly wih me instead of consoling me.i am fed up with his attitude because he never see around and starts yelling at me in his loudest voice anyewhere and in public places also..it is affecting me very badly both physically and mentally as it is very embarrassing and insulting in front of others,what action i can take against it and can it be base for divorce if yes how much time would it take?

as your marriage is just 3 months old, you may face difficulty filing a divorce petition now. however, you may seek help of a marriage counselor or talk to the elders of the family and if nothing improves, seek help of a lawyer to file the petition for divorce on the grounds of mental cruelty along with an application for waiver of statutory period.

Mr. Rajiv is right. First try to involve your elders, else file complaint in women cell and they will call your husband and try to make him understand and behave in normal manner. Even then if it did not work out then file divorce or case of seperation and various other options are there, so you may met any local advocate and he will guide you thorougly or you may send your details at [email protected]. but first of all try to compromise.

If the elders are not able to control him and his temper then you can go for divorce along with an application u/s 14 of HMAct to condone the statutory period 1 year.
