Legal Question in Family Law in India

I got married on 22nd Jan 1997. She is an advocate. We gave male child birth in 1999. Up to 2003 we lived together with some problems usually between a husband and wife. I was earning very low income during those period from a private school as a teacher. In 2003 my wife applied for divorce and I challenged it finally divorce granted to her in April 2006. In 2007 I have got Government job on last 14.03.2010, I married a girl. Now my former wife sent me a notice demanding money for maintenance. It is well known that I should give for my son. What about her? Is it

legally right to demand being a petitioner and an earning person? Please guide me in this regard.

If she is earning, she may not be entitled for any maintenance at this stage. However, a lot may depend upon the terms and conditions contained in the final divorce decree.

depends upon divorce condition and main point on which ground she file divorce.

If she herself left you then she may not be able to demand being a earning hand also.

So you need a detailed consultation. So consult any local lawyer or send your complete detail at [email protected]
