Legal Question in Family Law in India

I got married to Sarita last year in July. Just after two months of marriage she left me and went to her sister's place and complaint to the women cell about me. The complaint was that she did not wanted to stay with my parents but instead stay alone with me. I did what ahe wanted. We started staying in delhi and my house expense was handled by my parents. After one month she became pregnant and after nine months she gave birth to a baby girl. I was with her throughout her pregnancy and took care of her during the time of delivery. Once again she left me and went back to her sisters place. Right now she is at ther sisters place and again went to the women cell. Just last week when I went to meet my daughter at her sister's place her brother-in-law created a tiff and hammered me badly and called the police and both her sister and brother-in-law framed wrong charges against me. But fortunately I had not done anything wrong the police left me. Now the position is that she is still with her sister and I am staying in Jaipur. My child is just 2 months old. They do not allow me to meet my daughter nor they answer my phone so that I can know the welfare of my child. Right now I am only interested to meet my daughter, how should I do that. Is there any legal laws that I can meet her. Since my wife is not a working women I want the custody of my daughter. What age I can have her custody. Is there any Family Court in Jaipur so that I can put an application for the same

Dear Friend,

please find our suggestion as below

- You may file a petition for custody of the kid and alternatively you may file for the Restitution of the Conjugal Rights as well if you want to reside with you wife again.

- As Mr. Rajiv said, you will have to file the same at Delhi only, reason being that was the place of your last matrimonial home.

- There is no set law pertaining to the age bracket on which custody can be granted as a subject matter.
