Legal Question in Family Law in India
I got married on Sept 1999. My self and wife and girl baby are US Citizen as well as DUAL citizen also. My wife is mentally and physically not capable to handle day to day activities for my baby. I applied for DIvorce and Child custody also. My wife filed a complaint aganist my family member under sec 498a & 406. My wife wants to go back to USA with my child. My child passports with me and her jewellery in bank locker and bank locker is my name.Court has issued a AB in that bail court ordered to bank not open the locker by both thr parties. Now mywife filed a petition in court for passport and defreezing the locker. Can court allow my wife to open my locker and hand over the child passport to wife to allow to go US. Please help me.

Where did you get married ? And Where are you now ? Where is the child ?can you scan the copy of FIR against you and your family members. There is no Dual Citizenship.You could be OCI card holder . Please clarify all this and i can surely help you.
you need to hire a lawyer in India and defend your case. in case she has moved an application for the impounding of your passport or defreezing of the accounts, it needs to be opposed by the lawyer. even your AB can be applied in your absence and the same can be obtained. an effective legal representation would solve your problem. a case u/s 498a/406 is not considered so serious that the career and life of the husband is jeopardized.
