Legal Question in Family Law in India

I was married on 21st Jan 1995. When we got married my husband was abonded by his family. We had nothing except a bag of clothes and started a fresh. We made our home etc from 1995 to 2001. In 2001 when I was expecting and had to leave my job we started a home run travel agency. In the begining the agency did well. During that time my husband also had lost his job and as the agency was doing well we both started working on it. Over a period of time the business did well but the shine hit the wrong side. Earlier we use to have small fights between each other but now our fights started getting bigger as the expenditure by my husband on outings, friends, cell phone went beyond a point. Basically he did not like being questioned and this hit the business as the money was used was fromt he company. Eventually due to daily tit wits I decided to move out and be at home. By this time he did owe some suppliers money and started blaming me for it and stopped giving me any payment in hand to run the house.

Frustrated with no penny on me I looked for a job and decided to start working where in he put is foot down stating will not support me at all even when it comes to take care of our son. If i put him in the day care i will have to manage his expensive. Agreeing to all I started working.

The business started loosing out he started having an affair, drinking, not going to office etc and in all the doldrum the office closed down with a financial liability of 6 to 8 lacs

Eventually after doing all this in October 2009 he had a fight with me as he got a call from a company for a job in Mumbai and left me and my son and went off. he did not financially help us for nearly 6-8 months. We dint have idea where he was or where working untill thru some connection I got to know he was working in an Agency in Mumbai and got him on call. Thats when he started support by sending amt of 7 - 10 thousand per month to my account. However he again left that job and has moved where we have no contact except on email or one cell number which is rarely on or answered. I want to know how long does a man and women stay apart where I can just go to the court and say he has left us and would like a legal seperation as I frankly dont have lot of cash and am not financially that stable to appt lawyers and have told him couple of times to come and give a seperation mutually which he ignores.
