Legal Question in Family Law in India

i am married , my wedlock start from 13th dec. 06 to till date, till now 33 month,from frist day to till now she live near by 7 month in interval with me and my family. we have one child of 2 yrs old,every time i have taken intiative to call her back, lastly i send her notice to come back and she answered by claim U.S 125 cr.p.d. on me from delhi, and as we r staying in maharashtra both the family her and my in maharashtra only and from last 6 months i am jobless, in such case what i can do plz. suggest me.

you need to hire a lawyer in delhi immediately so as to avoid any circumstances where she would obtain ex parte order of her desired maintenance. this is the time to defend yourself and not repent. her maintenance petition is an outcome of your notice sent to her.

File restitution petition in Family Court Maharashtra.

Attend the hearing in CrPC case and inform them about A) You have asked yor ws therefore You will maintain her ONLY if she joins you with the kid.

Appoint a local lawyer in the Magistrate Court who is well versed with these kind of proceedings..
