Legal Question in Family Law in India

I was married in the year 1979 in delhi. My husband leave the house in the year 1993 with the information to my father-in-Law and my brother in law. I have three son from my husband. My brother in law and my father in law told me that he will come back and I still waiting for him. My father in law died in the year 1994. At that time my husband came back and once again left the house after completion of last rights. I still waiting him to come back but in the 2009 i have come to know from some reliable sources that my husband married in the past. I also give complaint in the Dr. Ambedkar in the month of july but after completion of one month, the police has not taken any action in this regard.

In this regard, it is requested to kinldy direct me what can i do. Because i earned my livelehood from working in the houses.

Please direct the all in step by step and how much money required for this case.

You have several remedies. For one - under Domestic Voilence Act for compensation and right of residence. It will have to be seen also whether who is the first wife - you or other one. Your complaint will depend on this fact. As regard address is concerned you may start with the last known address and also serve him by way of publication in the newspaper.

You can approach Delhi Legal Aid Service Autority for free legal aid. Being a woman you are entitled to free legal aid including court expenses. All you have to do is to approach the office at one of the locations - Patiala House, Tis Hazari, Dwarka, Karkardooma or Rohini courts. You will be provided a lawyer to whom you do not have to pay a penny.

first and foremost u try to to find about the the where abouts of ur husband. ur brother in-law must be knowing about it. if u know the name of the 2nd wife of ur husband then file a police complaint stating therein that ur husband has contracted 2nd marriage and his brother i.e. ur brother in-law has connived at ur husband's deed . when police ll interrogate ur brother in law he will tell them the whereabouts of ur husband. the police ll register offence under section 494 of ipc against ur husband and ll also book ur brother in-law for aqbetment of the offence. Since u r legally wedded wife u r entitled for maintenace as well as residence under the provisions of law. contact legal aid office at Patiala House, Tis Hazari, Dwarka, Karkardooma or Rohini courts u ll get a lawyer free of cost. if u have any further query pl mail me at [email protected]
