Legal Question in Family Law in India
i was married two years back and blessed with baby boy now my kid is 10months old... after delivery due to misunderstandings i requested my husband to look for a house so that we can seperate from our inlaws for which after several quarrels we got into seperated from our inlaws. But later after a month my husband suddenly left me and my kid alone and went away to his parents and now it is almost three months he did not turned up and not willing to come back to me. where he says he is not interested to come out from his parents. The main reason for it he can not maintain the family he doesn't have the seriousness to work hard and doesnot feel any responsibilities. Neither he asked me to come to his house and stay. Frankly speaking i am not interested to go to my inlaws house since i was very badly hurted with their words. Now i am staying with my mother along with my 10months kid. Infact i am not working and depending upon my mothers pension. Completely iam depending my son's all medical expenses and vaccinations etc., etc. on my mother. I am feeling very guilty. Even my mother and my cousins tried to approach him and convince my husband but he is not listening. Now how can i lead my life with my child. please advice me and help me out from this situation.

in your situation, once you know that your husband is an escapist and he is unable to handle the responsibilities expected out of a husband. it is upto you to decide what you want to do ...still want to go back to good for nothing husband or start your life afresh. as you can write well, you can also get a good job and you can take good care of your child. may be after a few years when you able to stand on your feet, your husband may also learn to earn and you guys patch up....alternatively....u may concentrate on your child.
You are suffering 'economic', physical and emotional violence. You may take appropriate action against your husband in accordance with the PROTECTION OF WOMEN FROM DOMESTIC VIOLENCE ACT.
