Legal Question in Family Law in India

I got married 5years back and stayed with my husband for 1year.after 1years as his family didnt accept me he left me and asked me to just go for a mutual divorce. so we jsut signed in a stamp paper that we dont have any relation furthure. its being 4yrs we dont have any contact but my family is planning for my marraige again, so should i have to get a legal divorce? we didnt have a registerd marraige it was just a ceremony in the temple i just have th photos. What shall i do? and if my ex- husband is married will be leagl for him too>

If no body creat problem then it is OK. other wise go for mutual divorce
