i have been married for last nine years and have two daughters. my wife has slapped me and my family with false accusations in police. i have tried my level best to continue the marriage but she has been admant on breaking it by giving one reason or the other. i still want that she should resolve and start living. however she has agreed for settlement for mutual divorcee. i want to take the custody of children but i know she will not agree. what should i do

unless the custody issue is decided, divorce by mutual consent cannot be filed.
in mutual settlement try to resolve all your disputes amicably including the issue of custody. This will be purely personal. If she does not agree, you may split the custody. it could be one daughter with you one with her. or both daughters with her for six months and with you for another six months or both with one and the other gets the visitation rights.
