Legal Question in Family Law in India

I am married for 7 seven years. The torture became unbearable and left the house with my 5 year old son around 3 months back. My husband is harrasing me over phone and trying to get the child. How do I ensure that I get the legal custody of child as primary guardian ?

you may file a complaint under domestic violence act and the desired reliefs may be granted by the magistrate.
