i have been married since last 8 years, me & my wife had a dispute & we signed a deed of divorce through mutual consent on 100rs stamp paper and got registered in the sub registrar office in ahmedabad.

Now my wife is insisting me to come to mumbai and file a divorce with mutual consent in a family court in mumbai, and if i disagree with it he is threatening me that she would file mental harassment case against me.

they have send me the petition for mutual consent in which they have demanded me so many things, and i was forced to sign that petition, can any one help me how can i withdraw the petition & what is the procedure, i have filed the petion one month back.

Divorce deed signed by you is just an agreement between you and your wife.

For the purpose of divorce such deed is not sufficient. the petition for mutula concent divorce has to be file before the Court.

In your case the you people have filed the Divorce petition before the court.

Under such petition the girl can demand money , articles etc. but subject to your consent only.

You can appear before the court and submitt that though you want the mutual concent divorce, but you will not be able to pay all the stuff which she is demanding.

you can contest the divorce. your previous signing and registration of agreement(divorce deed) is not valid divorce but only an agreement.

You should better agree with your wife and go for mutual consent divorce. The papers signed by you earlier will not be sufficient to dissolve your marriage.
