It may be proper for yoy to check his divorce papers, and if they are okay, to check his legal status, i. e. his green card, passport etc. Please request him to give you xerox copies of all above papers, and keep same with your mother before you depart.

Also, have the marriage registered, and photos etc taken of the social marriage, if any.

It ay also be prudent, nce you reach USA, to write a letter regarding the fact of your marriage, to the Indian Consulate in that area, askng him to keep your letter on record, just in case.

As Regards your query as per limited facts as naratted, Firstly you need to confirm his status as a divorcee by perusing and checking the appropriate valid court's decree of divorce. You may request for all the photocopies pertaining to the same. Only after perusing the same you may take further steps for getting married.

It is would be advisable that you inform the U.S. Consulate as regards your said proposed arrangement and your married status after the valid registration of your marriage for the purposes of record for the further compliances if required. Hope this should clarify your query.

If he is a divorcee as he claims then there is no legal complications and if you marry him you will have the full legal status of a wife and his prior marriage would be immeterial .Please check whether he has got a divorce decree and ask him to show it you. Anyway that would be required for the registration of your marriage .Thank You.
