Legal Question in Family Law in India

Matrimonial law

Please suggest,

My fiance was forcefully married by her parents about 8 months back. She was literally made to sit at the ceremony at gunpoint and forced to undergo saptapadi and exchange of garlands but she never had gone to her in-laws house and since her marriage she is staying at her parents abode only. Now please advice me how to get rid of the so-called marriage? Is the she is married at all in the sense that the way she was treated and force to undergo the ceremony?? Can I marry her straightaway without getting any decree of annulment form the court since court proceedings takes ages to finish? Please suggest any legal loophole through which this thing can be sorted out.[Marriage has not been consummated]

Regards,

Delhi

Re: Matrimonial law

Even if the marriage is not consummated, and/or she was forced to marry, she has to obtain a divorce before you could marry her. She may also opt for making an application for declaration of the marriage as null and void.

Either course is time consuming, at least one year to 18 months.
