Legal Question in Family Law in India
I am Mohammad Jassim Shaikh (53 years Old) My marriage from the year 1982 as a Christian ended in the year 2004 when I accepted Islam as my choice of religion and until this day we have no contact/ seperated, not officially Divorced, Currently she is living in India and I am working in Kuwait . Although I should add the fact that 22 years of my marriage with a Christian wife was not very impressive at all. I have a grown-up daughter named Melissa 27 years (unmarried) old from that marriage. I had supported my daughter whole heartedly, financially throughout her higher education in UK and still supporting although she is working and earning her own in Bangalore/ India. I have no contact whatsoever with the her mother but she is living in the house which we
jointly owned in Coimbatore /India.
My daughter is requesting on behalf of her mother that the half share of this property which is in my name must be given to my Daughter. I had agreed, but on the condition that I would for the share is all I need an official Divorce.
For this request, my daughter writes that, you have done illegal marriage without the consent of my mother five years ago, so she is not interested now to run-about for the offical procedings.
In the year 2005 I have got married the second time under Islamic law in India, but I do not know the Indian Islamic marriage act / constitutional reference code number etc that I am eligible to marry another muslim women without seeking prior consent from the Christian lady I previous was married to and so that I can tell her that I am married in India in the year 2005 not illegally.
I need a verdict from this LawGuru site.
