Legal Question in Family Law in India

Last month on 30/12/2009 I sent compensation notice of Rs. 25 lakhs to my husband. . But he has not taken it seriously. He prefers to remain silent and there has been no reaction from their side.

Reason, he doesnt plan to call me back and cannot pay the amount. They cannot pay beyond 1 lakh. The proposal of divorce and compensation was from their side.

So, what is the next action to be taken in this matter? Should we start with the negotiations or should we wait for them? It has been 8 months,he is not reacting to any emails from my side and not trying to settle the matter.

Wait for one year, take judicial separation, then apply for divorce, and claim the alymony.

You can issue one legal notice for negotiations and then decide further course of action.

You should immediately register a criminal case against him u/s 498-A/406 IPC.

Besides, you may also consider his criminal prosecution under Domestic Violence Act.
