Legal Question in Family Law in India
Hi Mr. Kalra,
The sole custody of the child is with me with no visition rights to the father. He had no problem with these terms as he was never keen for the girl child. Ever since her birth he has never tried to call or meet her.
Even though after going through a tortureous life with him, after divorce I met him and pleaded with him for his consent as I don't want a broken family for my child but he refused point blank saying that he will never let me or my baby be happy.
Now tell me is the law fair... I have to request a person and bend on my knees in front of a person who is least bothered about his baby...I am feeling so bad.. I could not give my baby a happy family and when life is giving me another chance for her, law is not allowing me...
Anyways I know I cannot change law but would appreciate if you could show me even a single ray of hope...

your problem is more social than legal. there is no law that can compel a husband to stay with the wife even for the sake of the child. however, the husband is duty bound to maintain his wife and child. it may be so that you refused the visitation to father at the first instance that he is adamant now.
