Legal Question in Family Law in India

THe mutual divorce is done after 6 months. In july 2011 the first hearing was done and second is due in january. what if one party does not appear? The agreement deed says that if one party back outs the other party will have to pay back. The compromise has been settled in 5 lacs, girl has already rec 2 lacs what if she does not appear , she does not want a divorce now, can there b serious implications. DVA case has been closed but FIR is yet to be closed against the boy? The girl is ready to pay back 2 lacs to boy. What is statutory interest, in accordance with law?

IF BOTH PARTIES WILL NOT APPER THEN THE COURT WILL NOT ALLOW THE DIVORCE

U/S 13(B) BOTH PARTIES HAS TO GIVE THERE STATEMENT TOGETHER.
