Legal Question in Family Law in India

my niece adopted a female child of two and a half yrs.Jaipur court has given the custody of the in may 2009,to both the parents. Now there is disputre between parents and living seperately.The child is living with parents.But, as per the court both parents have to appear before the court for final adoption before the jaipur court. if the adopted father refuse to appear before the court than what are the complications would appear? The mother in any case would not like to leave the girl and she is an asstt proffessor in a reputed University.

She may be awarded the custody.
