Legal Question in Family Law in India

My niece is getting divorced on mutual consent with three months to go out of the six months. She has a 10 year old girl and the husband has promised to pay Rs 10000 for the wife and Rs 30000 for the child per month. The payments in the last three months have not been prompt. It appears that the husband is likely to go abroad. My niece is worried about the prompt payment of the sum promised every month.

Is there a method of ensuring prompt and definite payment with an intermediary like a bank etc?

you may file appropriate application in the court expressing your apprehensions and praying the court to secure your rights.

your neice can file execution of the decree and summon her husband to pay the balance and ensure the payment is made on time. as far as apprehension of husband going abroad, in case your neice can show to the court that her apprehension is well founded, the husband may be restrained from leaving the country or his passport may be deposited in the court.
