Non Consummation of Marriage

We have been married for 4 years. Marriage is yet to be consummated. I have done medical tests which show that I am not impotent. Lack of consummation is posing a lot of problems and there has been a total breakdown of trust and love in the marriage. Id lack of consummation sufficient grounds for annullment? How much time will it take for that after I file for that? Do I need to live separately?

Non-consummation of marriage is a ground for nullity of marriage. You may better separate and file a suit for nullity and other reliefs, if any, that may available to you in accordance with law.

You can file divorce on medical grounds. but you should be firm that there is problem in your wife.

Else first made test of your wife also that will be help you.

a marriage which has not been consumated a voidable marriage ( Sec. 12 of HMA 1955) at the option of the either party. and under the petition for the anullment of marriage should have been filed with in one year of marriage. now yoy can obtain divorce under section 13 Of HMA, If both the parties arehindus by religign
