NRI Husband filed divorce in US
I and my husband married in india in may 2007 and after that we went to US after 19 days. after living in US for few months I was forced by my husband and in laws to leave US. My all streedhan is lying in the custody of my husband and my in laws who are in India. In my absence he change his contact details. recently I filed a case of dowry harrasment and domestic violence agiant them and proceedings are going on. In the mean time my husband has send me the divorce papers. It was written that I need to reply it in 20 days. What should I do? they have ruined my life. can I contest his petition for divorce in India. I can not go to US because of Visa and financial constraint.

I've still to understand why people from Fbd are being cheated like that. Two other parties had the same problem dealt with through this office in the recent past.

You were married as per Hindu Marriage Act and in India so you have every right to approach the family court seeking divorce,maintenance,streedhan and conviction to all the persons involved in the case with proper evidence.In my opinion your husband cannot seek divorce in any US court as the marriage was as per HMA.After you file a case against him and others,whoever are involved,your husband will be brought to India by police.

you can file a separate petition for divorce in india, however it is advisable to contest the case file by your husband in US .

Y9ou may be entitled to apply for a green card on the basis of 'domestic voilence' and pending divorce proceedings.
