Legal Question in Family Law in India

If an NRI man marries a Indian resident woman in India during the process of divorce with a foreign national whom the NRI was married before and if the marriage took place with the Indian woman 10 days before getting divorce.

In this case who is going to be prosecuted for bigamy the man or woman? If the Indian woman knew about the divorce but later she shows being ignorant in this case will only the man get prosecuted for bigamy?

i dont think this will be bigamy case since bigamy should be present at the time of filinfg the case. But as per you it was present when you married but is not as on date.

You are worrying too much and going on raising same queries in the forum. Don't worry since you will not at any cost be prosecuted for bigamy but at the same time there will be harrassment by the girl's side to squeeze money from you which you cannot avoid. Be calm and wait for the opportune time to defend yourself in the case if at all they file any. But don't bother about any oral threatenings. Tell them to take action legally and bravely face it.

Only husband can be prosecuted but he will be saved later on.

Good luck.
