Legal Question in Family Law in India

I am a Parsi Zoroastrian and divorced. My daughter (12) although in mothers custody chooses to reside with me. I want to formalize this arrangement. What must I do. The mother is willing to let the daughter stay with me.

let her statement in the court be recorded that she is leaving the custody to you.

You may file a petition first and then your wife will make the statement in the court for you to get permanent custody
