Can a person residing abroad, become the guardian of a mentally unstable person residing in India? Who is more eligible to become the guardian the person with whom the mentally unstable person is staying and being looked after or the person who visits once in two years? The person with whom the mentally unstable person is staying is the sister in law i.e. his elder brother's wife. The person living abroad is his brother.
Can he object to this sister in law becoming the guardian. If yes, on what basis?

sister in law is entitled for guardianship and not the one who stays abroad. even though he objects, he has to show that he is capable to take care of the person and ready to come to india or take him along.
