we planned a love marriage . 15 days before marriage my wife told she was involved in a short affair with umone . this disrupted my relation and led to domestic violence .we had a baby after 2.5 yrs of marriage and my wife went to her parens house 15 days before delivery and now both ae residing with them . they are planning for divorce . what should i do . all my efforts to bring her back were futile . what should be the compensation for dv and child support . we both r doctors

Apart from legal advice I would like to give you a humane advice. mere revelation of short affair rocked our life and despite that you decided for marriage with that girl. Has you been feeling rocked due to such revelation before marriage, it would have been better to get separated. Now you have entered into a marital alliance with it is the duty of both the partners to maintain the same and moreover the welfare of the child should be the prime consideration.

Now both of you should resort for the mediation of elders of both families and should try to resolve the crisis. Even if you are not able to resolve the issue, you should go for legal settlement which may involve divorce, custody of child and future maintenance of wife. Maintenance is alway commensurate to the status and income of the couples. Divorce with mutual consent shall be the excellent idea if both of you are agree for same. As far as the custody of child is concern, it could be decided mutually or else take legal recourse for that.

You have to support the child irrespective of her or his custody. If wife is earning, you need not to provide maintenance for her. Child is the liability of both of you.
