pls help me . I am having some querry.i filled transfer petition for the divorce case filled by my husband in bihar to guajrat in supremecourt.My husband filled transfer petition for 498 case and DV case filled by me in gujarat to bihar.Today i read the judgement of suprecourt like this,learned council appearing for the petitioner wife seeks time to take instructions from the petitioner whether she is willing for the transfer of case to delhi.i want all case to be transferred to gujarat. not in delhi

It isnot clear whether you have put your apparance in the supreme court on the petition filed by tyour huband. As a general rule supreme court will transfer the matrimonial matter to the place where woman reseide. Now there is an amendment in law and it has been incorporated that woman can file the case where she reside. However the balance of convenience will be weighed by the apex court.
