Legal Question in Family Law in India
I have posted a question previously regarding alimony & child custody.Thank you Mr.Karla for your quick reply.The ans to Mr.Karla's questions are- We got married in India and he has filed for divorce 2 months back.We both are born in India, but my son is born in USA.
PLEASE MORE ADVICE AND SUGGESTIONS ARE NEEDED.
My husband is working in US & his income is 30 lakhs per year.He has not spent a single rupee on me or my son since he is born.He is 2 yrs old now,so I can't start earning immediately.He has filed for divorce under desertion & cruelty grounds....can he prove that in court?
He does not want to pay me the maintenance,what should I do?
Can I ask him to show all his assets in court ? he had an insurance in USA,in which he made me 40% & my in-laws 60% partners,can I claim that too?
Please help me!!

even if he is able to obtain an ex parte divorce in US, the same is not valid in india and he has to file a suit to declare it valid. you may file a petition for seeking child support and spousal support before the district judge and you can show all his assets including the insurance where you are a 40% partner.
