Procedure to ake divorce

How to take Divorce with out knowing to our parents.

I am married 6yrs back.i am not intrested to saty with from my first day.he is ready to give.we dont have sexual relation ship.if we go with mutual consent how much time does it takes and is it possible to proceed with out knowing to parets.he wont tell to his parents and mee to.what the complete procedure.should we go to court or consult lawyer.and tell me the complete procedure please.

1.how long it takes in mutual consent?

2.did parents require for this?

3.our marriage is not certified.

4.how long it take from my side that i am not intrested to stay with him?

5.what are the documents require for this?

Parents are not reuired either to present in the court or to sign the divorce papers however some blood relation or responsible person from the wife side court required to avoid fraud.

6 months period for divorce by mutual consent is prescribed in the statue but court has power to wave this period. It is advisable to consult the lawyer or me

1. there is a waiting period of six months after filing teh petition. which if waived you my be able to take a divorce earlier. if not wiaved that including the said period may take around 7 months.

2. no parents are not required

3.you will need proof of your marraige like wedding photo, address proof etc

you have to take 6 months of time after getting divorce by mutual consent and yes for this procedure parents are not required.

The procedure for obtaining divorce by mutual consent is very simple. You do not need any lawyer. The only requirement is to go and file a petition before the District Judge of your area. He may record statements of both of you and fix a day six months after. On that date, he will confirm your decision to seek divorce and shall dissolve your marriage.

The parents are not involved in any manner.

The total time taken is about six months.

The only documents required are supporting affidavits of both of you.

1.Six- seven months,if the court did not wave statutory period.

2. Parents are not required in the proceeding.

3.It does not matter,however,you shall be required to give the proofs like photographs,invitation cards etc.

5.Ration card or election card,Residence proof,two photographs of each person,photo of marriage,Invitation card of marriage.
