Thanks for the prompt response. Yet another question from me... Both me and my husband have decided to go in for divorce by mutual consent and are in the process of seeking a well-experience lawyer. Both of us feel very uncomfortable and dont want to accuse each other of anything and hurt each others feelings in our last encounter. Both of us are aware of our faults and just would like to let the lawyer know that we can't stand each other and that we are not living like a wife and husband are supposed to for the last 1-1/2 years. My doubt is should we have to tell the lawyer the entire story of all the happenings, misunderstanding etc. Does the lawyer have to know it in order to help us better. Another doubt is how long will we have to wait for the divorce to actually happen. What exactly is the procedure. I would appreciate if you explain it in a fair amount of detail. The steps involved in the process, etc, how to go about it since we both are nervous. Thank you in advance.

you do not have to explain each n every minute detail to your lawyer or to the judge. divorce by mutual consent is a no fault divorce and is granted by mere statement of the parties that they cannot stay together due to tempramental differences. you need to explain anything to your lawyer for it. a petititon of first motion is filed and afte six months, the second motion is to be filed and divorce is granted. so in all there is a wait of six months. no need to be nervous as the process is simple. twice your statment would be recorded by the court. just hire a competent lawyer.
