Legal Question in Family Law in India
Psychopath
My wife is a psychopath. She used be very violent & aggressive. I & my mother suffered injuries. We gave many complaints to police but they didnot took any action. She also created ugly scenes in the neighbourhood. Once she left to her native and I had to send the legal notice. She came back but increased the violence. When I decided to go for divorce, she filed cases under 498A & Domestic Violence Act. Even after that she continued the violence and later I booked 324, 506 against her and then I left her and applied for divorce. Now, I came to know that she is living with one more guy. She is taking maintenance from me. She is fighting all the cases with great spirit and happily spending time with her boy friend. These are all the symptoms of a psychopath. Now, how should I prove her psychopathic nature in the court cases. Can I ask court to refer her to a pschiatrist and get her verified? How to convince the court to prove her psychopathy? has anybody faced such a case before? Please help me.

Re: Psychopath
(1) You may need to first check the allegations in your divorce petition; you may make an application for medical check up only if you have specifically pleaded of her medical illness.
(2) You may make an application to the Court for a direction to get her medically examined by a team of doctors which may be constituted by the Court or by the Civil Surgeon /Medical Superintendent of some Government or reknowned hospital of your area.
(3) Since it is a pending court case, you may better seek opinion of your lawyer for making appropriate applications/strategy to pursue your remedy.

since it is a pending case and you have already engaged an advocate, so it is advisable to trust your advocate and share the information with him and seek his opinion
