Legal Question in Family Law in India
Public nuisance by my wife in order to de-fame me in public
My self and my mother have been booked under 498A, R/W 3&4 of DP Act in August 2008 based on my wife's complaint. We were jailed and got released on bail. After that my wife along with her parents have forcibly occupied our house, man-handled us and they threatened to finish us if we don't give them money. One day my father-in-law black-mailed my mother to kill me if she doesn't give money to him and he forcibly took her to our native place to with draw money from my mother's account. I was captivated in my house by my wife and her relatives. I got escaped and lodged complaint under sections 324, 342, 504 & 506 R/W 34 against my wife and her parents. Then after few days I applied for divorce. My wife filed case under DV act. Now, after 3 months, she is making calls to my friends & colleagues and she is telling them that I have done all these wantedly. Basically she is trying to de-fame me in public. But, She sents SMS to my mobile giving apologies. Yesterday she came to my office in order to see me. I did not meet. She might try to come to my office again and again and create scenes in front my office in order to de-fame me in public. If she does that, can I get any case registered on her? If so, under what sections?

Yes, you may seek a retraining order prohibiting her to stay away from you, more particularly during the pendency of civil / criminal cases pending in courts.
However, you are strongly advised to make efforts for an out of court settlement and try to reach a compromise for all the issues involved. This kind of litigation is expensive and tiring and uncertain.
