This with regards your query and the limited facts as naratted, Presumebly both are Indian Citizens, One can definitely initiate legal proceedings against the criminal cruel behaviour of either of the spouse at the appropriate forum in India at the place where the parties got married or has place of their residence in India. You may intimate the local police at both the places and can file a complaint under the preview of crminal law in India as per Indian Legislation and invoke an immediate legal process for the wrong doings Hope this should suffice your query in brief.

yes you can file case in india.
first of al tell me, what are the instances of torture in india.
why does he want a divorce.
are you ready to give him divorce?
because unless a divorce is given by consent, a divorce, if contested is very tough to be obtained in india.
and a divorce obtained in USA ex-parte is not valid in india unless the same is ratified by the indian law as well.
therefore, the niformation given by you is insuficient.
you need to give more information.
regards.

A suit for divorce as well as under the Dowry Prohibition Act, and alimony should be filed immedaitely in India, in a court, which has jurisdiction over the place where they were married.
