Legal Question in Family Law in India

i am asking this question on behalf of my brother who got married 4 months back.

My bhabhi has gone to her parents home without informing any of us. Then only my brother told us that their married life was not going well as she used to fight with him on small small things after which she used to stop talking to him till he would feel sorry. She even specified about her desire for divorce and told my brother to take the initiative as her family members would never agree for divorce. Suddenly we got shocked when four of her family members came and allegated my brother that he is impotent and they want to get him tested for that. He got very hurt and told us that their is no probelm like that. and they had a normal sexual relation. . Everytime we try to talk to her family ,they say the same thing. Our Family gets very upset with that . .We have made our mind that if she does not want to continue we would agree. But we want to stop them from making that false and unreliable statement again and again . .Now when we told them that we are ready to get his tests done they told that we can bring the false reports from anywhere. This false allegation would badly effect my brother 's life. Please guide us what to do to stop them from doing this anymore.

it is clear from your post that the girl is not interested in carrying on this relationship. you may talk to her parents and try to settle the matter amicably. after waiting for eight more months, your brother and his wife can go for divorce by mutual consent. read more on divorce laws on my website www.karvai.in.

Your brother may not be able to stop the girl and her family to impute false allegation(s) against him legally but can surely divorce her now by moving an application u/s 14 of hindu marriage act by convincing the court of some valid urgency and i am sure would grant and allow you to file a petition for Divorce by waiving the period of 1 year.
