this question is for Mr.S.Seshadri- sir, this question is related to my past question regarding my divorce....My husband is on H1B visa and have applied for green card but i don't know about the status. I am Indian and residing in Chennai. Our marriage took place in chennai tradionally and also legally registred. actually he used to do physical harassment and tortured me mentally by listening to his parents....but all this happened 3yrs ago...if i file a case against him for divorce will my case be strong? all are saying is that its been long time so if i file a case it will not be valid and also my husband has filed divorce before i did...so can i win if i put case on him from india?

u will definately win. coz marriage solmnize in India and only Indian court has power to divorce the same.
About time spam it is not a problem you can file any time.
You can sue him for physical and mental torture and or dowry by filing appropriate complaint/ petition.
Your husband's prior filing for divorce does not give him any advantage. I suggest you follow the steps outlined by me in my previous answer.
You will have to consult with documents and facts a lawyer for taking further steps.
