Legal Question in Family Law in India
I have another question. My son who is 6 now hates his father so much that he wouldn't even touch a single thing such as a toy that his father gets for him, not to mention the father very rarely gets a toy or such for his son. My son would go throw it out or in the garbage basket. I know that his hatred towards his father stems from the fact that he has seen me sad and depressed around his father and he is smart enough to understand that im not happy with his father. Since my mom lives very close to us (just 3 buildings apart) me and my son are living literally in my mom's place for the last 1-1/2 years. I visit my place just to get some of my stuff, like clothes, etc. My son doesn't want to see his father and if my husband comes to my mom's place to see our kid, my son just runs inside and refuses to see him. Now since me and my husband have decided to go in for a divorce by mutual consent and also my husband says he will give over full custody rights to me, will he be allowed visitation rights if he so wishes, and he is aware of the fact that his son hates him and will refuse to see him. I don't want it to be hard on my kid. Pls let me know if it will be forced on the kid to see his father in this case. I am so worried.

despite the fact that your husband can seek visitation rights but the same would be decided by the court considering the welfare of the child. if there is so much of hatred in the mind of the child, visitation may be disallowed. i hope you are not actively behind that hatred.
