Legal Question in Family Law in India

We both r Christians my wife sent me Notice u/s, 10(ix) of Divorce Act 1869 praying for a decree of divorcee, We both separated in 2006 with notary agreement which is not valued I learnt is now. What should I do i need divorcee fast? Explain me the procedure and steps please guide me,

I belong to Karnataka State, I have a girl child now she is 7 years.

My wife is working as HDFC bank asst manager says that she doesnt want any compensation because she has already take before in the year 2006, But she want to for her daughter 7 year old, Im afraid whether my she will ask share in my Property which I have taken for my office use 1100 sq ft. And even my brother is purchased a 3 bhk flat property under my name he is NRI. We are afraid that she will demand share.

What is the solution ...........?

I consulted a lawyer is he muslim he says Please keep on Praying. But Im tensed I want to know whether she will put any cases on me put me in trouble.

And what is Under Section 13 of the Family Court Act

Please Help

I and ailing parents are sleepless with this tension.

13. Right to legal representation.- Notwithstanding anything contained in any law, no party to a suit or proceeding before a Family Court shall be entitled, as of right, to be represented by a legal practitioner: Provided that if the Family Court considers it necessary in the interest of justice, it may seek the assistance of a legal expert as amicus curiae.

Hire any good lawyer and he will guide you right solution after checking your documents. but dont worry there is solution and she will not be able to get your property.

Please note one thing, so far so property is concerned, India is not like US, where they have to share community property. In India wife is only entitled to maintenance, and not share in property. Second thing, if property is self owned property, then even children do not have any right to claim any kind of share in property. So making claim in property is absolutely out of question.

Another thing, you can fight for your child custody. Since she is 7 yrs, court will even ask for her wish and will. Retain a good lawyer in family court. You just have to seek court permission for being represented through attorney, and it is granted as a matter of course.
