Legal Question in Family Law in India
With regard to my earlier question regarding mental torture faced by me from my husband i want to elaborate that though he wants my money, he tries to avoid his day-to-day responsibilies towards the family, espicially me. He also humiliates me in front of his nearest family, utters derogatory things while having sex just to show me down, has a lot of inferiority complex from me which i came to understand gradually while living with him since last 10 years. He cannot stand if anybody appreciates me, tries to overshadow me in public. Many a times I have tried to make him understand that we should be like friends and there is no competition between me and him. But he has no control over his senses and feels boosted when he makes me upset or cry. Sometimes I feel he needs psychiatric help and have even offered to go with him. But he threatens me that he would make me "mad" and would "torture me everyday". Me and my parents have tried to talk to him and his family but to no avail. Now I take care of my finances myself which is not being liked by him. I take care of majority of household expenses, my and some of my son's expenses on my own. I am not at all dependent on my husband either financially or otherwise. We are not having any physical relations since last six months because of his humiliating behaviour. Pl. advice me how can I protect me and my son's right in that house?

Try to resolve the matter amicably with the help of elders present in the house or some common friends. Even then if things go out of reach then file a case of DVA and demand only to live in the same house and maintenance for your child.

you have not mentioned which part of india you belong to.
in your situation, again its a matter of matrimonial adjustments. as he is having complex as he may not be a handsome man and you a beautiful woman. he is not torturing you coz of your beauty but due to the comparison that others force upon him. as an educated woman, you may ask him to see a psychiatrist and cure this complex or try and push him to go for yoga classes. courts and litigation is not the solution for you. i wish i could see you both in person.
(a) You should minimize your contact with him.
(b) It may be better if you consider living independent of him.
