Legal Question in Family Law in India

Hi, related to your answer ( Ref No: NWOWno8oHt), what is the procedure to get the child custody immediaately. Do we need to log a complaint in police station as it is a law that up to 5 years mother alone is the custodian....and police simply intervene and resolve this matter, OR do we need to simply file an application under guardian & ward act for permanent custody of the child as suggested by you earlier through lawyer...but i guess problem here is this will be time consuming and by that time court will order, child becomes 5 years of age.....

Please suggest.....

Also as metioned earlier my sister left her husban't hourse 4 months back, so did she any issues for this in the court. ?

the child is in whose custody for the time being. the best way is to file a petition for custody and meeting rights for the time being. all other ways are not legal.
