Legal Question in Family Law in India

Hi

I am in relation with the married lady for past 9 years who has 5 year old child form me, she is staying with her husband only, her husband has filed a petition for divorce in the family court where held her Respondent & co-respondent to me.

Sins I have no plans to be with her so we all three have decided to solve it amicably through court where I will be paying some amount towards the maintenances of the child..& in return she will Scot me free from her, as I have always faced situation where me & my family is in the worst days of our life.

I am afraid my step of giving maintenance for the child through court, shouldn�t put me in any further legal problem in future, (wil it come under Live in law)

if you can tell me the risk by doing so�

Not only that she is entitled to maintainence, she would be entitled to compensation under the Domestic Violence Act. Also the child would be entitled to share in your property if you, his father, die intestate.

You should try to reach an out of court amicable settlement and make payment of a lump sum amount towards PERMANENT ALIMONY. The husband is entitled to condone your adultery in terms of Cr. P. C.
