Legal Question in Family Law in India

Its a remarriage for my former wife. and I do not marry. I have a son aged two and ten month and staying with his mother. The child (whose birth date 04.10.2007) has stayed with mother from november,2008.( an affidavit signed by the father and mother during divorce that if the mother will remarry then she will back the son to father.) The father of the child filed a case in Purba Medinipur District Judge Court claiming custody of the child.Whats are the possibility to become custodian?

The custody of a child below five years old is normally given to mother.
