In the child's school, give the name of your current husband as child's father name. If school ask for proof, then you may give the (i) decree of divorce from earlier husband (ii) proof of marriage with current husband.

You may also publish the change of name of your son (from say sumeet to sumeet malhotra) in Part IV of the Gazzette of India.

you have to take consent from your former husband for adopting the child.

if without his consent you change child's name he may complaint to the court and apply for custody of the child.

without an express consent of ex husband, who happens to be the natural guardian of the child, the name of father of child cannot be changed. the biological father has to consent for the same.
