Re: replicant

replication means reply of written statement filed by respondent before the court. it is not necessary to file coz in the whole civil procedure, no where it is written to file a replication, but if you want to file counter to the written statement of the respondent, then you are at liberty to file the same.

Re: replicant

The replication is only to provide you an opportunity for bringing on record any additional pleading in response to some new facts that may be pleaded in the written statement of opposite party.

if replication is not filed, you may go ahead with evidence. there is no adverse affect on the case.

Re: replicant

You perhaps mean REPLICATION and not REPLICANT. Replication essentially means a rejoinder/reply to the Written Statement filed by the Respondent. If nothing new and worth rebutting is stated in the Written Statement, replication can be avoided. Filing of replication is not mandatory. In fact there is no legal provision for replication under CPC. Shraman Sinha
