Thank you for your reply. I had already file case u/s 24 (in which against order he approach two time to high court then after filing execution he paid some amount only)
125 (Till date no order) just to delay the order they always come with new application. even they file 340 against me & my lawyer. Actually both my parents are retired teacher and I don't have any source of income. Now we all are fed up and I am ready for divorce even he is not ready to pay lum sum. please suggest me what is my & my child right in his and his parental property. (he is say he don't have any property on his name) when I was married he was having one shop & flat other then father's property. He is the only son and there is no libility on him.

it would be difficult to give an opinion without going through the orders of the court below and the high court.
You may claim child's custody from the Guardianship Court. You should also be entitled to maintenance as per his standard of living at the time of separation. The child may be entitled to a share in the property of his parents / grand parents.
The child may also claim for maintenance........has full right in ancestral property but no absolute right in the self acquired property of the father. For clarifications feel free to contact the undersigned.
