Legal Question in Family Law in India

Repost for Rajiv Gupta and others

Actually I do not wish to live with my wife since she is mentally unsound but I cannot afford the alimony, hence I have no choice.

I can only afford upto Rs 6 lacs lumpsum in case of divorce.

How do I solve this problem? She is not agreeable for mutual divorce also.

In fact I am scared of the possibility that even if I treat her well she might blame me for illtreatment and suicide in her suicide note which can cause trouble for me. God saved her last time and I was lucky.

If I have to take her back, I think I must tell the court beforehand that such is the case before taking her back. How do I do it?

You are supposed to give details of your income before the h'ble court and you cannot skip of that if you are well off.Whatever you mentioned about your wife commiting suicide targeting you as a criminal is all nothing but fantasy. The prosecution,if at all, would rely by the facts and not cock and bull stories. If you really want to get divorce for any reason you file petition for divorce for that what you need is a local lawyer, who you trust.Stop brooding and spending sleepless nights.

You may live normal life with your wife without any fear of being involved in a suicide note etc. if you do not intend any wrong doing on your part.

in case she had attempted suicide and the nature of her act was grave, there is no point patching up with her as she might repeat the same act again and no court can guarantee you that she will not repeat her act. better be free instead spending rest of your life behind bars coz even though she commits suicide, any member of her family can accuse you u/s 304B of indian penal code.
